END USER PRIVACY POLICY

Throughout this document, references to “Company”, “our”, “us” or “we” are to ORB Universe Ltd, a limited company registered in England and Wales as company number 11131965.  The registered office is City House, 3 Cranwood Street, London EC1V 9PE.  To contact us about this Policy, use contact@orbuniverse.com.  Capitalised terms that are not defined in this Privacy Policy have the meaning given them in our terms.  The following key words are used frequently in this document:

Through the App we provide the capability for:

i)         a User’s ORB to be published and for the User to gain insights into its adoption, use and utility,

ii)     you (an End User) to access a User’s ORB, and

iii)    both parties to interact in various ways e.g. communication and feedback.

Personal data

Information that relates to an identifiable person who can be directly or indirectly identified, in particular by reference to a personal identifier.

 

To operate and provide our Services, we collect, disclose, protect, store and use certain information about you.  These activities and the choices you have about them are explained in this Privacy Policy.  We use certain legal wording in this document.  The headers in bold below are not part of the legal Privacy Policy and are not binding on us.

For the purposes of EU data protection laws ("Data Protection Legislation"), the Company is the data controller i.e. the company which is responsible for, and controls the processing of, your personal data.

Your Personal Data

We do not knowingly hold any personal data.

Anonymous Data

The App records your anonymous behavioural (adoption e.g. which web resources are accessed, and use e.g. how long resources are accessed for, how resources are categorised etc) and emotive (utility i.e. service ‘mood’ rating) interactions (data) which we may analyse, interpret, publish findings on and research in order for the Company to operate and for us to provide and improve our Services and create new Services.

The App enables you to send comments to Users.  These are sent to email addresses chosen by those Users.  The Users can then respond within the App to you.  If you or the User choose to include personally-identifiable information in these comments or responses, we have no responsibility for that disclosure.  The App does not record any comments or responses.

When you download the App and register to use it, you are required to input two items of information in order to uniquely identify your version of an ORB within the App and to send you in the App a unique code so that you may access your version of an ORB from other devices.  It is your decision whether the information you input is personally-identifiable or not.  We do not need personally-identifiable information to operate the App and we do not sell your information.  We encrypt any information you input.

Data Security

We use commercially-reasonable safeguards to preserve the integrity and security of all information collected through our Services.  Data is stored in Amazon Web Services (AWS) data centres.

We are not responsible for the practices employed by apps, websites or services linked by Users or ourselves via our Services, nor the content contained therein.  When you use a link to go to a third party app, website or service, our Privacy Policy does not apply to it.  Your browsing and interaction on any third party app, website or service, including those that have a link on the App, are subject to that third party’s own rules and policies.

You agree that we are not responsible for and we do not have any control over any third parties that you authorise to access your personal data or other content, feedback or information.  You do this at your own risk.

This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources other than through the App.

Data Sharing

We may share your PI with certain third parties who we require to maintain, operate and provide the features and functionality of the App and our Services. 

We may also share your information with third parties as required to:

i) satisfy any applicable law or regulation,
ii) enforce our terms, including the investigation of potential violations thereof,
iii) investigate and defend ourselves against any third party claims or allegations,
iv) protect against harm to the rights, property or safety of the Company, its users or the public as required or permitted by law, and
v) detect, prevent or otherwise address criminal (including fraud or stalking), security or technical issues.

Changes to this Privacy Policy

We may modify or update this Privacy Policy from time to time to reflect changes in our business, practices and the law and applicable regulations so you should review this document periodically.  When we change this Privacy Policy in a material manner we will let you know and update the ‘last modified’ date below.
